Terms of Service

These terms govern your use of MentionSweep (the "Service"), operated by MentionSweep ("we", "us"). By using the Service you agree to them. If you don't agree, don't use the Service.

1. What the Service does

MentionSweep sends questions to third-party AI assistants (such as ChatGPT/OpenAI, Google Gemini and Perplexity) and reports whether and how your brand appears in their answers. AI answers vary from run to run and change over time. Scores, rankings and suggestions are estimates for informational purposes, not guarantees of visibility, traffic or revenue.

2. Accounts

You sign in with a link sent to your email. Keep access to that email secure; you're responsible for activity on your account. You must be at least 18 and able to form a binding contract.

3. Purchases, billing and cancellation

Full Report (one-time purchase). The Full Report is a single payment for a single report, delivered digitally shortly after payment. Paid plans are not on sale yet. Refund terms will be posted here before checkout opens. Statutory rights that cannot be waived still apply.

Monitor and Agency (subscriptions). Billed monthly in advance through our payment processor (Stripe) and renew automatically until cancelled. You can cancel or change plans anytime from the billing portal; cancellation takes effect at the end of the current billing period, and we don't refund partial periods unless required by law.

Report credit. If you buy a Full Report, the amount paid may be credited toward your first Monitor invoice if you subscribe within 30 days of the report purchase, once per report. The credit has no cash value.

We may change prices with at least 30 days' notice for subscriptions; changes apply from your next billing period.

4. Acceptable use

Don't use the Service to break the law, infringe others' rights, attempt to access accounts or systems you're not authorized to, overload or reverse-engineer the Service, resell it without permission, or abuse the free score (for example by automating requests). We may suspend accounts that do.

5. Your content

You keep ownership of the brand names, domains, prompts and competitor names you enter. You give us permission to process them to operate the Service, including sending them to the AI providers listed above. We may use aggregated, de-identified results (for example "which tools AI assistants recommend in a category") to publish research and improve the Service.

6. Third-party services

The Service depends on third-party AI providers, payment and email services. We're not responsible for their outputs, availability or changes, and their own terms apply to them.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.

8. Limitation of liability

To the fullest extent permitted by law, we won't be liable for indirect, incidental, special, consequential or punitive damages, or lost profits or revenue. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

9. Termination

You can stop using the Service anytime. We may suspend or end access for breach of these terms or if we discontinue the Service (in which case we'll refund any prepaid unused period).

10. Changes and governing law

We may update these terms; if changes are material we'll notify you by email or in the app. These terms are governed by the laws of the State of California, United States, excluding conflict-of-law rules.
